Terms of Service — ChillBoss
Last updated: 3 November 2026
1. Who we are and what these terms cover
ChillBoss is operated by SALEUP PTY LTD (ABN 74 642 236 511) ("we", "us", "our"). ChillBossis software for local businesses: an AI receptionist, online booking, a customer list (CRM), email and SMS messaging, and review tools. These terms are the agreement between us and the business or person who signs up ("you"). By creating an account or using ChillBoss, you agree to them.
2. Your account
- Give us accurate details when you sign up and keep them up to date.
- You are responsible for your login, your team members' access, and everything done through your account.
- If you sign up for a business, you confirm you have authority to bind that business to these terms.
- Tell us promptly at the contact address below if you think your account has been accessed without permission.
3. Acceptable use
You must use ChillBoss lawfully and sensibly. In particular, you must not:
- send spam or any commercial message that breaks the Spam Act 2003 (Cth) — see section 4;
- upload or send anything unlawful, deceptive, defamatory, harassing or that infringes someone else's rights;
- try to access other customers' data, probe or attack the service, or reverse engineer it beyond what the open-source licence allows;
- use the AI receptionist to mislead people about who they are talking to, or for emergency services;
- resell or white-label the service unless we have agreed to that in writing.
We may suspend features that put other customers, recipients or the service at risk.
4. Email and SMS campaigns (Spam Act 2003)
When you send marketing email or SMS through ChillBoss, you are the sender and you are responsible for compliance. That means:
- Consent: only message people who have given consent (express, or inferred from an existing relationship as the Spam Act allows). Keep a record of how and when you got it.
- Identify yourself: every message must clearly identify your business and how to contact you.
- Unsubscribe: every marketing message must include a working way to opt out, and you must honour opt-outs within 5 business days. Our unsubscribe links and STOP handling help, but they do not replace your own obligations.
- No purchased or scraped lists.
We may pause a campaign or your messaging if we receive complaints or believe the rules are not being followed.
5. AI receptionist and call recording
The AI receptionist can answer calls, chats and messages on your behalf, and calls and conversations may be recorded and transcribed. You are responsible for telling your customers that they are speaking with an AI and that the call may be recorded, and for meeting any consent and notification requirements that apply to you under the Telecommunications (Interception and Access) Act 1979 (Cth) and the surveillance and listening-device laws of your state or territory. ChillBoss includes a default notice at the start of calls, but you must make sure it is accurate and sufficient for your business.
AI can make mistakes. You should review bookings and messages it creates, and you are responsible for how you use its output. It is not a substitute for professional, medical or legal advice.
6. Your customer data
- You own the customer records, bookings, messages and other content you put into or collect through the service ("your data").
- You give us permission to host, process and transmit your data only to provide and secure the service, as described in our Privacy Policy.
- You are responsible for having a lawful basis to collect your customers' information and for handling it in line with the Privacy Act 1988 (Cth) where it applies to you.
- You can export or ask us to delete your data at any time; we will do so within a reasonable period, subject to legal record-keeping needs.
7. Fees, billing and cancellation
Paid plans, prices and any usage charges (for example SMS or call minutes) are shown at sign-up or in your billing settings. Prices include GST where we say so. Fees are charged in advance for each billing period unless stated otherwise. You can cancel at any time from your account; access continues to the end of the period you have paid for. Except where required by law (including the Australian Consumer Law), fees already paid are not refunded. We will give you reasonable notice before changing prices.
8. Third-party services
ChillBossrelies on providers for things like telephony, SMS, email, payments, hosting and AI. Their availability and terms are outside our control, and some features may need you to connect your own accounts (for example Google or Stripe). If you connect a third-party account, you must follow that provider's terms.
9. Availability and changes
We work to keep ChillBoss reliable but cannot promise it will be uninterrupted or error-free. We may improve, change or retire features, and will try to give notice of changes that significantly affect you.
10. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Our services come with guarantees under the Australian Consumer Law that cannot be excluded.
Subject to that, and to the extent the law allows: we are not liable for indirect or consequential loss, loss of profit, loss of customers or goodwill, or loss caused by third-party services, by your instructions, or by your failure to follow section 4 or section 5; and our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim arose. Where the law allows us to limit our liability for a breach of a non-excludable guarantee, we limit it to resupplying the service or paying the cost of having it resupplied.
11. Suspension and termination
You may stop using ChillBoss and close your account at any time. We may suspend or end your account if you seriously or repeatedly breach these terms, if required by law, or if you do not pay. Where reasonable we will give you notice and a chance to fix the problem first. On termination you can request an export of your data; after a reasonable retention period we delete it, except where we must keep it by law.
12. Open source
ChillBoss is built on SeldonFrame, which is released under the GNU Affero General Public License v3.0 (AGPL-3.0). The source code of the version we run is available on request — contact us at the address below. Open-source components remain under their own licences.
13. Changes to these terms
We may update these terms. If a change is significant we will tell you by email or in the app before it takes effect. Continuing to use ChillBoss after that means you accept the updated terms.
14. Governing law
These terms are governed by the laws of Queensland, Australia. Each of us submits to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
